Creation of Trusts

We assist and advise clients on the setting up of various types of trusts.
A trust is a legal structure created by a person known as the founder of the trust. The founder creates the trust for the benefit of defined beneficiaries. The assets of the trust are placed in the care of trustees named by the founder who then hold and deal with such assets on behalf and in the interest of the beneficiaries.
Trusts can be created whilst the founder is still alive – known as an inter vivos trust – done by executing a trust deed and registering same with the Master of the High Court, or a trust can be created after the death of the founder – known as a mortis causa trust – created in terms of the will of the founder.
Our turn around time for the setting up of an inter vivos trust is normally between 1 to 2 weeks.
